The EU Migration Pact Takes Effect: Can EU Handle Migration?

On 12 June 2026, the European Union’s long-awaited Migration and Asylum Pact officially became fully applicable across the EU, marking the most significant reform of European migration policy in more than a decade. The Pact represents an ambitious attempt to address longstanding challenges related to asylum procedures, border management, responsibility-sharing among Member States, and the return of unsuccessful asylum applicants.

The new framework was adopted by the European Parliament and the Council of the European Union in 2024 and entered into force that same year. Following a two-year implementation period, the legislation is now being applied across the Union.

The migration crisis of 2015 exposed deep divisions among Member States regarding responsibility for asylum seekers. Countries located at the EU’s external borders in the south, such as Greece, Italy, and Spain, often carried a disproportionate burden, while other Member States resisted mandatory relocation schemes.

The Pact seeks to create a more predictable and more coordinated system by establishing common procedures, strengthening external border controls, and introducing mechanisms to ensure solidarity among Member States.

A New Screening Process

One of the central features of the Pact is a new screening process for migrants arriving irregularly at the EU’s external borders. Individuals will undergo identity verification, security checks, health assessments, and biometric registration, including fingerprinting and facial-image collection. This screening can last up to seven days.

The enhanced use of the Eurodac database is intended to improve information-sharing among Member States and prevent multiple asylum applications in different countries.

Faster Asylum Procedures

The Pact introduces accelerated border procedures for applicants whose claims are considered unlikely to succeed, particularly those arriving from countries deemed safe. These cases can be processed more rapidly, allowing authorities to reach decisions sooner than under previous systems.

Supporters argue that faster procedures will reduce backlogs and discourage abuse of the asylum system. Critics, however, fear that accelerated processing could limit applicants’ ability to present their cases adequately.

A New Solidarity Mechanism

Perhaps the most politically significant innovation is the introduction of a mandatory solidarity mechanism. Member States experiencing high migratory pressure can receive support from other EU countries.

Countries that do not wish to accept relocated asylum seekers may instead provide financial contributions, operational assistance, or other forms of support. This compromise was designed to bridge longstanding disagreements between governments with differing views on migration.

More Effective Return Procedures

The Pact also seeks to improve the return of individuals whose asylum applications have been rejected. EU institutions argue that a credible asylum system requires effective mechanisms for returning those who have no legal right to remain in the Union. New procedures aim to accelerate returns and improve cooperation with countries of origin and transit.

Recent discussions have also focused on the possibility of establishing return hubs in third countries, although these proposals remain controversial and subject to legal and political scrutiny.

Reactions and Concerns

European Commission leaders describe the Pact as a balanced approach that combines responsibility with solidarity. They argue that it strengthens border security while preserving the right to seek asylum. The Commission has repeatedly emphasized that no Member State should be left alone to manage migration pressures.

Human rights organizations and refugee advocacy groups, however, have expressed concerns. Critics argue that the new rules place excessive emphasis on deterrence, increase the use of detention, and may restrict access to asylum procedures for vulnerable individuals. They warn that implementation must be carefully monitored to ensure compliance with international human rights obligations.

Challenges Ahead

Although the Pact has now taken effect, implementation remains a major challenge. Several Member States have faced difficulties adapting their national legislation, building the necessary infrastructure, and preparing administrative systems for the new procedures. Technical problems affecting the Eurodac system on the first day of implementation highlighted some of these concerns.

The success of the Pact will ultimately depend on whether Member States apply the rules consistently and whether the new system can deliver faster procedures, effective border management, and genuine solidarity among EU countries.

The entry into application of the EU Migration and Asylum Pact on 12 June 2026 marks a historic turning point in European migration policy. Whether the Pact succeeds in achieving its objectives remains to be seen. What is certain is that its implementation will shape the future of migration governance in Europe for many years to come.
